NovaGlimpse Terms of Service

By installing or using NovaGlimpse ("the Extension"), you agree to these Terms and to the NovaGlimpse Privacy Policy. If you do not agree, do not use the Extension.

These terms add to the Novawave website terms at https://novawave.llc/terms; if they conflict, these terms apply to NovaGlimpse.

1. What NovaGlimpse is

NovaGlimpse is a Chrome extension that works inside Gmail. When you send an email from Gmail in a browser where the Extension is installed, it adds a small invisible image (a "tracking pixel") to the message. When the recipient's mail client loads that image, the Extension can tell you the message was opened. NovaGlimpse is not made, endorsed or sponsored by Google. Gmail and Chrome are trademarks of Google LLC.

2. Who can use it

You must be at least 13 years old (16 in the EU and UK), and able to agree to these Terms. If you use NovaGlimpse for an organization, you confirm you are allowed to accept these Terms for it.

3. Your use and your recipients

  • You may only use NovaGlimpse with Gmail accounts you own or are authorized to use.
  • You are responsible for the emails you send and for how you use open information about them.
  • Tracking pixels are regulated in some places (for example under GDPR and the ePrivacy rules in the EU and UK, and CAN-SPAM in the US). You are responsible for using NovaGlimpse lawfully where you and your recipients are, including any notice or consent the law requires.
  • You may not use NovaGlimpse to send spam, phishing or unlawful content, to harass or surveil people, or to break Google's terms.

4. License

Novawave grants you a personal, non-exclusive, non-transferable, revocable license to install and use NovaGlimpse in Chrome on devices you own or control, under these Terms. You may not:

  • copy, resell, rent or redistribute the Extension
  • reverse engineer it, except where the law allows this
  • interfere with, overload or try to gain unauthorized access to the NovaGlimpse service
  • use the service with anything other than the Extension, or in a way that tries to identify or track specific people beyond what the Extension shows

5. The service and what "opened" means

  • NovaGlimpse is free. We may introduce paid features in the future, with notice.
  • The Extension depends on a small service we run that records when a tracking pixel is loaded. We may change, suspend or stop that service at any time. If it is unavailable, opens that happen during that time are not recorded.
  • "Opened" is an estimate. It means the pixel was loaded. Mail clients that block images will never register an open; some mail clients and security scanners load images automatically before anyone reads the message; viewing your own sent mail on another device counts as an open. We do not promise that open information is complete or accurate.

6. Updates and availability

We may update NovaGlimpse to fix issues, add features, or follow changes in Gmail or Chrome. Gmail's web pages change from time to time; when they do, parts of NovaGlimpse may stop working until we update it, and we are not responsible for that.

7. Feedback

If you send us suggestions, we may use them freely without any obligation to you.

8. Ownership

NovaGlimpse, its name, logo and design belong to Novawave LLC. Your email and content remain yours.

9. Disclaimer

NovaGlimpse is provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose and non-infringement. We do not promise the Extension will be error-free or uninterrupted, or that open information will be accurate or complete.

10. Limitation of liability

To the maximum extent the law allows, Novawave is not liable for indirect, incidental, special or consequential damages, or for lost data, profits or business. Our total liability for any claim about NovaGlimpse is limited to US $50. Some places do not allow these limits, so they may not fully apply to you.

11. Ending use

You may stop using NovaGlimpse at any time by removing it from Chrome. We may suspend or end your license, or block the Extension from our service, if you seriously or repeatedly break these Terms. Sections 7 to 12 continue after termination.

12. Governing law

These Terms are governed by the laws of the State of Washington, USA, without regard to conflict-of-law rules. Disputes will be handled in the courts of Spokane County, Washington, unless the law where you live gives you the right to bring a claim locally.

13. Changes

We may update these Terms. We will change the effective date and, for important changes, tell you in the Extension or on this page. Continuing to use NovaGlimpse after changes take effect means you accept them.
